You may need to "edit criteria search" and adjust the dates to search for current notices. 

Posting Fee for Foreclosure / Trustee Notice is $2.00. Per section 51.002(f) of the Texas Property Code. 

You will need 3 copies of the Notice,1st is for the County Clerk, 2nd is for your records and the 3rd copy is for you to post. 

The County Clerk's office is not responsible for posting the Trustee Notice/Foreclosure on our Public Bulletin Board, we only file the document and post the notice to our public website.  You are responsible for posting the Notice on our Public Bulletin Board, per section 51.002 of the Texas Property Code. 

The clerk may dispose of the notices after the date of sale specified in the notice has passed.

In Texas, a Notice of Trustee's Sale or Substitute Trustee's Sale, related to a foreclosure, must be filed with the county clerk and publicly posted at least 21 calendar days before the sale. This notice provides details about the debt, the property, and the three-hour period during which the sale will occur. The county clerk's role is to file-mark and maintain these notices, not to conduct the auction.

Purpose of Filing:

Filing the notice with the county clerk and publicly posting it ensures that the public, including potential buyers and the borrower, are aware of the pending foreclosure sale. 

Timeline:

The notice must be filed and posted at least 21 days before the scheduled sale date. 

County Clerk's Role:

The county clerk's primary responsibility is to record and maintain these notices, ensuring they are accessible to the public. 

Public Posting:

In addition to online posting, the notice is typically posted in a designated public location, like the courthouse. 

Information Included:

The notice contains crucial details about the property, the debt, and the scheduled sale date and time. 

Non-Judicial Foreclosure:

Texas is a non-judicial foreclosure state, meaning the sale can occur without a court order. 

Substitute Trustee:

The trustee or substitute trustee (acting on behalf of the lender) conducts the foreclosure sale. 

When is the trustee sale held in Coleman County?

The trustee sales are held on the first Tuesday of every month on the Front Steps of the Coleman County Courthouse from approximately 10am to 4pm.  The County Clerk’s office is not affiliated with these sales; therefore, we do not have any information.  Any questions that you may have concerning these sales must be directed to the Substitute Trustee conducting the sale.

How do I find out if a property is being foreclosed on?

There is a bulletin board inside the front door of the Courthouse containing all of the properties going up for sale for the month. Or you may click on the above link (Coleman County Foreclosure Notices).   The County Clerk’s office cannot give this information over the telephone.
